Singapore’s Latest Insolvency Reforms: What Will They Mean in Practice?
Singapore’s corporate restructuring and insolvency framework has developed considerably over the past decade. The latest reform recommendations seek to further enhance that framework, addressing aspects of judicial management, cross-class cramdown and restructuring tools, as well as cross-border and enterprise group insolvency.
The recommendations include a greater emphasis on the restructuring and turnaround function of judicial management, proposed changes to existing cross-class cramdown thresholds and its expansion to include shareholders, and measures intended to facilitate the implementation of restructurings. They also include the proposed adoption of the UNCITRAL Model Laws on Enterprise Group Insolvency and on Recognition and Enforcement of Insolvency-Related Judgments.
With the recommendations broadly accepted and moving towards implementation, attention is turning to their application in practice. What could the proposed changes mean for restructuring strategy and the choice of process, creditor participation and restructuring finance, the dynamics between debtors, creditors and shareholders, and the handling of complex corporate groups and cross-border restructurings?
Organised by INSOL Asia Hub in partnership with the Centre for Asian Legal Studies, Faculty of Law, National University of Singapore, and Allen & Gledhill, this hybrid event will bring together senior legal, financial and restructuring professionals to examine the reforms and the issues arising from their implementation.
The discussion will consider what the recommendations could mean in practice and their significance for the continuing development of Singapore’s restructuring and insolvency framework.
