The collapse of a Ponzi scheme presents complex legal, commercial and forensic challenges. Beyond exposing the fraud itself, officeholders and their advisers must determine who should ultimately bear the loss, whether fictitious profits, commissions and other payments can be recovered, the extent to which recipients may rely on available defences, and how assets can be traced and recovered across multiple jurisdictions, particularly where digital assets are involved.

Drawing on the speakers’ firsthand experience of Ponzi schemes, fraud investigations and cross-border recoveries, the discussion examines the strategic and operational challenges of maximising recoveries in complex Ponzi insolvencies. It spans recovery strategies, investor defences, forensic investigations, digital asset tracing and cross-border recovery, while highlighting the legal, commercial and operational considerations that influence successful recovery outcomes.
